First Degree Criminal Sexual Conduct Charges in Grand Rapids, Michigan

The most severe sex crimes are classified as criminal sexual conduct 1st degree. They are sex offenses involving sexual intercourse, such as rape, sex crimes involving minors, and date rape. CSC 1st degree charges cover sex crimes dealing with sexual penetration, including oral, anal, and vaginal penetration.

A person is charged with CSC 1st degree if the following aggravating circumstances outlined in Section 750.520b of the Michigan Penal Code exist:

  • The alleged victim is a person under 13 years of age
  • The sex offender is related to the victim
  • The victim is between the ages of 13 and 15 and experiences mental health problems as a result of the sexual act involving penetration
  • The sexual offender hurt the victim physically
  • The offender used a weapon or what the victim perceived to be a weapon while engaging in sexual contact
  • The victim, who was already physically or mentally unable, has been physically harmed by the offender
  • The offender used their connection or position as a teacher, administrator, student, volunteer, or contractor to force sexual penetration (see: teacher sexual misconduct)

First degree CSC is a felony punishable by a maximum life sentence or a lengthy prison term. You may also be required to pay the court charges and a hefty fine. In addition, you will need to sign up with the Michigan Sex Offender Registry and can be subject to electronic monitoring for the rest of your life (see: CSC 1st degree Michigan penalty).

Second Degree Criminal Sexual Conduct Charges in Grand Rapids, Michigan

The most severe sex offenses involving unwanted sexual contact are referred to as criminal sexual conduct 2nd degree. A person may be charged with 2nd degree CSC for touching another person for sexual enjoyment or arousal without that person’s consent. These types of sex offenses do not include sexual penetration. Examples of CSC 2nd degree are child molestation and sexual battery.

Second degree criminal sexual conduct occurs when:

  • A victim under the age of 13 is involved
  • The alleged victim has a physical or mental impairment
  • The perpetrator forced the victim into the act while acting in a position of authority over them, such as a teacher, school administrator, substitute teacher or school employee
  • The alleged victim is aged between 13 and 16 and related to the offender
  • The unwanted sexual contact takes place while another felony is being committed
  • The victim was physically hurt during the commission of the other felony
  • The offender utilized force or coercion to perpetrate the violation
  • During sexual contact, the offender had a weapon or what the victim thought was a weapon

Second degree criminal sexual conduct has severe sanctions that can have a long-term impact on your life. Third Degree Criminal Sexual Conduct Charges in Grand Rapids, Michigan

Instances where a person is accused of criminal sexual conduct 3rd degree include:

  • The alleged victim, who is a person 13 thru 15 years of age, was subjected to sexual penetration or battery

  • The victim is a 16–18 year-old, and the perpetrator works at the school as a teacher, administrator, employee, contractor, or substitute teacher

The mandatory minimum sentence for those found guilty of CSC 3rd degree is one year in jail, and the maximum sentence is 15 years. Suppose a person has previously been convicted of a crime classified as first, second, or third degree criminal sexual conduct in Michigan. In that case, their sentence may be increased to a minimum of five years in prison (see: CSC 3rd degree Michigan penalty).

Suppose a defendant has a history of convictions for sex offenses, including gross indecency, rape, indecent liberties, or carnal knowledge in other states. In that case, they may receive the required mandatory minimum sentence. Fourth Degree Criminal Sexual Conduct Charges in Grand Rapids, Michigan

The least severe sex offenses in Michigan are considered criminal sexual conduct 4th degree. It involves non-consensual touching, just like 2nd degree CSC. It entails caressing another person’s private areas, including the inner thigh, breasts, penis, vagina, and anus.
